Why Is the AP Invoking the DMCA over the Obama Poster?

Why is the Associated Press invoking an ambiguous section of the Digital Millennium Copyright Act in its lawsuit against artist Shepard Fairey for creating a poster of Barack Obama from an AP photo? The answer is a greater potential for statutory fines that can pressure Fairey into settling the case.
