Free Press Response to Senate Opposition of Efforts to Defund Net Neutrality

On Wednesday, Sens. John Kerry (D-Mass.), Ron Wyden (D-Ore.), Maria Cantwell (D-Wash.) and Al Franken (D-Minn.) sent a letter to Senate leadership objecting to an amendment included in the House budget that would prevent the FCC from enforcing its open Internet rules and opposing a “resolution of disapproval” in Congress that would overturn the FCC’s rules altogether.

“We’re pleased to see that Senators Kerry, Wyden, Cantwell and Franken are stepping in to stop this dangerous overreach by a House leadership that seems intent on pursuing the telecom industry’s agenda instead of protecting the public interest. We thank the Senators for their efforts, and hope that more of their colleagues will add their voices to the issue and stand up for Internet users everywhere.”

Internet Speech Cases Turn on Procedural Grounds as the Supreme Court Articulates Strong First Amendment Protections for Content Moderation

While the Court remanded these cases for more fact-finding by the lower courts, it noted laws that prevent platforms from deciding which speech it will or will not host are “unlikely to withstand First Amendment scrutiny.”
